Payday Express - Urgent Help needed

Hi guys,

I have a payday loan with payday express, stupid i know. The loan is a month overdue however i have emailed them to arrange a payment plan but no reply. This morning I got paid and i was horrified to discover that £215 has been taken out my account by these people, i called them to query it and they said they are allowed to do it on the credit agree i signed.
I took a look at the credit agreement and it says:
'You authorise us to collect by direct debit, electronic or other means any monies owed under this Agreement on the Repayment Date or Future Repayment Date from any bank or debit card account of which you have supplied details to us. If the monies are not paid on these dates we may collect them at a later stage by giving you prior notice'
However I have not received a letter stating moneys will be taken, 17th of may i received a letter but it did not state moneys would be taken from my account in any way, shape or form.

Is there anyway i could get this money back as i cant really afford to lose it this month?

    You need to speak with your bank, they can dispute this for you. If by taking the money this has placed you into financial hardship, then under recommendations by the FOS they should return the money to you and negotiate a method of repayment that is affordable.

    No act of fraud has taken place, so i wouldn't have thought they will get it back. You gave this Payday company your authorisation to do this. They are under no obligation to set up a payment plan with you.

    The bank will attempt to request the payment refunded, however under the terms & conditions of the Credit Agreement, they may not be able to. However, as I mentioned, if you are placed into financial hardship by this payment being taken out, meaning you have no money to pay for food, rent etc, then you should make this quite clear to the bank.

    If the bank is able to get the money back, then it is likely that the lending company will either charge you for missing a payment or levy heavy interest onto the loan, so you need to contact them but put it in writing stating that you are in financial hardship (if you are) and that you need to look at an affordable method of repayment. Before they will even consider an offer of repayment they will need to know what your income and expediture is, you should send this to them in the form of a financial statement along with a letter stating how much you can afford to pay to clear the debt, obviously you should ask that all interest and charges are whitheld so that you can reduce the balance of the debt, however witholding charges and interest is at the discretion of the lender.

    It would probably be better for you to go and see someone in Citizens Advice or Call the National Debt Helpline on 0808 808 4000.

    Take Freddies advice. Switch of the ogle box, f the bingo and do not touch with a BARGE POLE

    You borrowed money, you are late in paying, you authorised a DD, they took money owed via DD, I see nothing wrong there, it's not their fault you didn't pay on time.

  • Hi guys,

    Need some advice..I place an application for a payday loan on the 20th of this month and all the relevant information was received contract signed blah blah blah and everything was ok upto the point of not receiving the money after three days of waiting(£120 in total - £150 payback).

    I have called and emailed the company(payday express) but they have been completely unresponsive.

    Fortunetly I called my bank on the 24th who confirmed that and I quote 'no direct debit or monies have been placed into your account from this company', the bank have since placed a watch on my account and cancelled my current credit card and ordered a new replacement.

    Recently I have found out that(through a call from my bank) asking me if I wish to verify allowing the removal of my funds for this repayment, obviously I have said no and the bank have been happy to comply.

    Obviously any help from you all would be gratefully received as I'm at my wits end as I will not be bullied into paying for monies I have not received.

    I've used their services twice before without any problem....

    As your bank are so helpful, why didn't you ask them for a £120 overdraft?
