You need to contact the JCP and ask them to send you an appeal (GL24) form, along with your medical report. You should also advise them that you wish to claim the appeal rate of ESA whilst you are appealing. If you are unsure of what to write in your appeal, you can seek help from Welfare Rights, CAB, DIAL etc.
I hope that makes sense - I have forgotten to go to bed, so what makes sense to me may not to anybody else! Feel free to ask any further questions, someone more awake should be online in the morning.Gone ... or have I?0 -

I appealed a few years ago for my mum when her incapacity benefit was stopped. Basically I was sent the paperwork that she filled in and a copy of the doctors report and what she scored. I sat and went through it all and wrote a 2 paged letter detailing where the doctor had went wrong. I sent it away and then we were invited to a tribunal hearing where the benfit was eventually re-instated. It was an awful process but one i was determind to fight as my mum is 100% entitled to her benefits.
Good luck with getting yours sorted.Total DebtWas £4145.81now £0.000 -
Here is a copy of the form.
Good advice from Hoopylass, just take each point in turn and explain why the information they have used is incorrect, and/ or how you meet the criteria. If you put each point as a separate heading, it makes it easier to follow.Gone ... or have I?0 -
