Ok.....someone please tell me HOW is he doing this...?

- Brief history and then PLEASE someone tell me how my ex is managing to pull this scam?? (Because I am certain he is doing something dodgy here)

After 5 years of writing letters to my MP and my case being passed onto enforcement (where the CSA gave my ex had a liability order and a DEO for non payment and arrears of over £5000) I was finally told he should be paying me over £400 a month. I have never had that amount however as he has protected earnings. He has a new job which he started after christmas - before he started he asked me to drop the CSA and go to a private arrangement because he said they would take so much money off him that he wouldnt be able to afford to see the children anymore - but I would never agree to this with his history. But now the last 2 payments have gone down to less than £100 a month? He hasnt seen our 2 children since february now because he tells them he is working every hour godsends and cant afford to see them...??? So... he is working full time, had a promotion in his job (same employer- higher position, more hours) but his payments to me have been REDUCED? I have asked CSA to do a reassesment twice now but heard nothing? Please someone shed some light on how he can get around the system????

    Not really productive there but it is possible that he doesn't earn as much money, or is self employed and his taxable income is less his expenses of doing business. If this is the case then yes, people do use this to reduce their CM payments but at the same time some people need these tax breaks to carry on doing business. I know form the other end of the scale.. The CM I would have to pay based in my future income makes it pointless to take the job, none of my cost of commuting is taken into account for CM purposes. Maybe his situation is similar but without more detail who knows..

    Thanks..no he isnt self employed so I cant figure it out - he works as a manager in a mental health unit and works night shifts.. He has always taken every opportunity to avoid paying CM in any form - even £5 a week is too much in his opinion....

    OP, maybe he is keeping his hours low, therefore in turn his payments due to his protected earnings and telling the children fibs as to why he cant see them!!

    Hope not but just a thought!

    I presume it is because she has 2 children that are entitled to the correct percentage of their father's wage. Simples.

    A. Yes and no. The CSA is riddled with discriminations and in the case of force if your a full time member yes you must pay like everyone else however if your a full time member of the territorial army then it's your lucky day, you don't have to pay a penny.
    "The Territorial Army is classed as a Special Occupation and Child Support Regulations state any payment made in respect of the performance of duties as a member of any territorial or reserve force
    is not to be treated as earnings." So we have people working full time, earning £20,000 a year and paying nothing. It's a case of one shoe fits all except those csa say it doesn't fit.

    It could be that he is actually taking home less working as a manager. The reason being that he will not have the overtime or shift enhancements. It makes up quite a significant amount. Of course that may not be the reason but I do know that when I was working my shift enhancements made up a large part of my pay.

    Sounds like the most likely story to be honest... :-( Well he is cutting his own nose off to spite his face in that case....!!!!

    Is it possible he is using salary sacrifice to put a fair chunk of his wage into his pension?

    I'm not sure if this can be used as a way round paying CM, but someone with more knowledge of the subject maybe will shed some light.
