hi,
this is my first time using a forum ever so try not to be too brutal. i am a student living in a house rented. i have been living there since october 2009 up until present. i am the only person in my house with a car so have most use of our driveway. we live opposite a council estate on a very small cul de sac. our driveway is a bit small and i drive a vauxhall astra. as stated i have been parking my car in my driveway for 8 months now going along with advice from my estate agent it is fine. however recently i recieved a ticket on my car in my driveway because
contravention code :62
parked with one or more wheels on or over a footpath or any part of a road other than a carriageway.

however as stated my driveways is not the biggest and i park my car all the way up until the wall. the back of my car does hang onto the dipped curb outside my house by about 6 inches but there is physically nothing i can do about it? i have lodged an appeal and am waiting to hear back. but now today i recieved my second ticket for the same thing!!! its really irritating because i am studying for my exams and am moving out in 2 weeks. ive parked 8 months without a problem and in my last 3 weeks i have already recieved 2 PCN's from the council, and after speaking to the appeals department on the phone it seems like i may get many more. please help!!

I take it the ticket you received was from the council. As this particular thread is about private parking tickets, could you please start your own thread so that it gets the attention it deserves. And welcome to this forum! What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -
I've split this out of the discussion thread for you ch1r88g. Welcome to MSE
For future reference you may start a new thread by going to the board view (where you see the list of threads) and clicking the blue "New Thread" button.0 -
A picture speaks a thousand words. Can you get pics of the car in the bay, to see what they are on about, you might have a jobsworth. Next pics/scans of the ticket with personal details removed, both sides. Host the pics on tinypic and copy the url. Paste the url into a post and remove the http:// bit.
Someone may be able to help then.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -

Same in my road. But from the OP's description his wheels are not just up on the kerb, his car is overlapping the pavement because the driveway is small.
In some areas, footway parking is a contravention (or at least some Councils allege that they have the right to issue PCNs for this as they are Special Enforcement Areas...).
On pepipoo.com, I have seen a defence to this contravention posted on several threads, where it's a Greater London Council (not sure if it applies to other Councils claiming to have Special Parking Area status?).
Basically the argument is that the pavement parking contravention is flawed I think, as there is no signage and there should be under the TMA 2004. I found the wording on this thread:
http://forums.pepipoo.com/index.php?showtopic=49318&hl=Special+Enforcement+footway
Needs pepipoo's proper input really, to form an appeal though. To the OP, ch1r88g, read the FAQs and stickies, host your images on tinypic and post a new thread here:
