DLA award regulations?

i need a dla expert if there is one on here, my 3 year award for dla(higher rate of mob&care) expired on 25th march, they recieved the forms on january 29th for my renewal application and passed the torch to ATOS after contacting my gp, is there a time limit in which they must act? i receved one letter from atos giving me 48 hours notice of there intended visit two weeks ago which i had to cancel due to prior arrangements and have heard nothing since, i am disgusted by the delay and if i had a car on motability scheme it would have been repossesed by now as i wouldnt have been able to make the last two payments!, I sent in mri scans and consultants letters stating that my condition had deteriorated over the last three years(i have 5 slipped discs etc. and suffer with chronic and acute pain) , is there some regulation that states they have to act within a certain time period? i realise i will get the payment backdated but i am struggling without it at the moment

    They do try to act within 11-13 weeks. However, if they require information from consultants, it may take longer.

    thanks for the reply, they are waiting purely on atos getting there act together, i was hoping there was maybe some sort of charter that said they had to act within a set time frame, i am having difficulties but my heart goes out to people in my situation who are less fortunate than myself, bunch of uncaring pencilpushers with absolutely no regard for peoples health or welfare!

    You seem to have forgotten that you are not the only claimant. The JCP and ATOS are very busy, and your renewal will be dealt with in turn.

    Perhaps you should be less judgmental about people whom you know nothing about. For all you know they could be claimants themselves.

    lol, i bet you would't be so judgemental of me if you were in my situation, pot-kettle-balck springs to mind!, i very much doubt that atos doctors or staff are claimants, in fact as they are contracted by the government that means my taxes go towards paying their salary, maybe they should employ more staff if they are unable to cope with demand rather than just allowing sick and disabled people to suffer due to their own organisations incompetance and greed, we are talking about a delay of two months here and not an admin error!, many many sick and disabled people must be suffering also due to this unacceptable level of incompetance, but you can bet your !!! that all the atos staff get paid on time every week,

    I have been in your situation, but I do not think it constructive to be so rude about people that you do not know.

    Please remember that many regular posters on this board are JCP employees. Please show some respect for fellow MSEers.

    Why would you doubt that staff are not claimants also?

    The comment about your taxes paying their wages could be turned around, as their taxes are used to fund your benefit.

    Of course you are entitled to your opinion like every other forum member, but please do not make generalized assumptions about people you have no knowledge of.
  • I would say that you did send your forms back in time for a renewal. If your money has stopped, you need to phone them ASAP and find out what is going on.
