Hello,
I am residing in Edinburgh and is on a rented flat. I am leaving from here wants to know clarify few things regarding the tenancy. I will be really grateful if you can help me with the same.
I rented this flat in 2008 on a 6months written contract and post which i stayed in the same flat until now.
I had emailed my owner telling that i will be moving out of edinburgh and also told him to be informed and told that i shall get back to him on the dates. But when i checked my email i found that i have mentioned only these adn never stated that Take this mail as a one months notice but it was understood.
Now since there is only a week for me to leave, he is telling that i should have given 1 month notice though i had already emailed him.
Kindly advice as iam not sure whether he will give my one month's rent back.
Looking forward for your advice.
With warm regard

I don't know the system in Scotland, but I wouldn't think that you can give notice by email  Important communications like this need to be sent in writing with proof of postage - not by text, email, jungle telephone, smoke signals or other creative methods!
I'm afraid that yes, you're almost certainly liable for another month's rent. If I were you I'd send off that written notice ASAP (and if you were in England I'd also add to make sure that it coincides with a rental period, but I don't know how this works in Scotland).0 -
I'm not really clear: are you saying that you thought you'd given your landlord one month's notice but now you realise that you haven't? In any case formal notice should have been given to your landlord in writing, not by email or text or anything else.0

I took it to mean that she had emailed her landlord to advise him she would be moving 'at some point in the future'.
Then she seems to say that this has been taken as her 1 months notice.
But then goes on to sound like she has told the Landlord with one weeks notice that she will be vacating.
And then the Landlord has requested a month's notice.
But that doesn't make much sense but it was the best I could make of it!0 -
In the email that you sent the landlord, did you tell him the date that you would be leaving?
If not then he can hardly be expected to take it as notice.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. If you haven't given clear unequivocal notice then you will simply have to negotiate with your LL: if s/he can get a new T in place asap it should reduce the amount of rent you may have to stump up.
Seek guidance from your local Council's Private Sector Housing Officer if your LL will not negotiate and/or you are unsure of your tenancy agreement terms.0
