Repair not covered under warranty

I bought a brand new car in March which comes with a 3 year warranty. I took it to the dealer this morning with the first problems I have come across. One being a faulty alarm and the second being lots of very tiny dots on the paintwork.

For the faulty alarm they have said they will order a new part and get it fixed under the warranty so that's fine.

The paintwork they want to charge £70 to do a polish to try and solve the problem. They are saying that it will not be covered under warranty because I must have parked it somewhere where people have been spraying something which must have splashed onto my car. I disagree with this because firstly I would not park a brand new car anywhere like that, secondly the dots look like holes in the paint they are perfectly round not like splash marks, and thirdly they are all around the car not just on one side. I said all this to him but he did not respond so I had no choice but to just leave it as I refuse to pay £70 for a polish.

Is there anything I can do about this? Surely I have a right to get it repaired under warranty? There is no way to prove that it was something that I have caused and their reasons are quite obviously not valid in my opinion. Should I go somewhere else for a second opinion? The next nearest dealer-approved garage is quite a distance from me I don't want to pay all that petrol for them to look it up on the electronic database and tell me the same thing.

    You won't need the dealer for a second opinion. Just go to a body shop and ask them what they think has caused it. You can then decide how to proceed.

    But if the paint is faulty go back and try them again, if no joy then contact the manucturer.

    You don't need an opinion, you can see the paintwork is faulty if this is all round the car. Get on to the manufacturer to bring the franchise back in line.

    What make of car & colour is it? Internet searches might show the problem to be more common than you think.

    Before fannying about, why not just try a little polish on the spots and see if it comes off?You're not going to damage anything doing so.
    I had a neighbour cover my car with creosote when they painted their fence, it came off easily enough though.

    It could be tiny tar deposits. Or do you live/work/park near a train station/railway line or on an industrial estate?

    Have these paint defects just appeared or were they there when you bought it?

  • Thanks for all the suggestions so far. For those who asked it is a black Mazda 2. I don't live near a railway line or industrial estate. I'm not entirely sure if they were there when I bought it, my partner only pointed it out the first time he washed the car, until then I hadn't even noticed it. According to the Mazda dealer they weren't there when they gave it to me but I'm not sure.

    There many things that can damage paint work. If a one places disgrace with you then you need a second opinion.

    I bought a black motor a couple of years ago and what with all the new roads where we were, it was inevitable that some tar spotting would occur. I bought some special stuff to take the tar off but the trick is that you have to catch it fast. In the end I gave up as it was a game I was never going to win. I guess if it had been a posh beemer or expensive merc then I'd have been well narked but it was a 4 cab pick up and it also gets used. You cannot expect it to look like it did at delivery forever.

    However, if the tar is not the problem and it is paint, then do get onto the net and then the manufacturer. I would advise being reasonably sure though as you'll be setting yourself against the franchise if it is not the paint.
