Mis sold Phone Contract by Tesco

Hi guys i will try and keep this as short as I can, Bought two phones and two contracts with orange through tesco Telecoms in store. Salesman told me the panther deal with orange was the best for me but it was only 500 texts. I told the salesman I needed unlimited texts to which he replied no problem and said he could add on a bolt on for £5 per month for unlimited text, which he did and it says so on my receipt. Two months later orange direct debit went through billing me for over usage of texts, i phoned them and told them i had unlimited to which they replied that that was not on offer at the time and I should get back to tescos. Tescos are claiming a systems error and have promised sort this out for me. 8 weeks later I am still awaiting payment for the over usage of texts that my daughter used, there has been a paper trail so long, and also the promise of a check 3/4 weeks ago that never materialised. Trading standards have said its mis sold contract and i should go to a small claims court now. Just cant beleive tescos are letting this go so far? Any thoughts on this?:(
