Not only is what the company requesting you do illegal on several issues you would also by accepting this open yourself up to being charged with conspiracy on every charge they may encounter and due to the fact you allowed it you would be guilty.Approach her; adore her. so your employers appear to want employ somebody that they don't wish to have to declare as an actual employee, this person will then be 'invisible' as such for any reporting to HMRC/PAYE etc., they won't have any official employees rights such as holidays, grievance procedure etc.
how many employees does your company have? i'm wondering if this is something to with legislation for companies withh 5 employees or less. if they take on 1 more, lots of different rules apply. just a thought.
i've never heard of anything like this, all seems very odd & i'd refuse to be involved point blank!0 -

I agree with this completely I would not let this happen and shame on your employer for even allowing it, if it is your friend who has asked for this I can only think of 2 reason as to why he would want to do it this way:
1/ He is claiming benefits and does not want a paper trail to be caught with.
2/ He has no legal right to be working in the UK for whatever reason.
I am sure there will be more reasons such as CSA etc but these are the only ones I can think of right now.
If your employer has asked for this then it has to be some kind of a tax dodge in which case I really would not involve yourself in such matters, having the Inland Revenue after you is not a nice prospect
I undeerstand you wanting to help your friend out but you have to think of yourself at the same time dont let yourself be brought into something without knowing the full reasons as to why, there is no way you weigh the "risk" up without the full information.
