Leasing a car, want to cancel....

Hi All
Im currently waiting on delivery of a new car via business lease.
THe problem being I ordered in Feb 2010 for a June/July delivery. I've now been told that delivery is not likely to be until October 2010. I'd like to cancel due to not having a car when I need it and being missold in the first instance.
I paid a £500 deposit in Feb and want that back also.
Anyone know what my rights are here? The car hasn't even been given a build week yet, so effectively its a piece of paper.

I guess what you can do will depend on the contract and the associated T&Cs. If it only quotes an estimated delivery date then it may be harder to get out of unless there is a clause that says 'If delivery is going to be x months after the estimated delivery date you have the option to cancel subject to the following charges'. If it quotes a delivery date then I would get onto them and say that they are in breach of the contract and therefore you want to cancel the contract.IT Consultant in the utilities industry specialising in the retail electricity market.

You could always speak to the dealership, they might show you a bit of leeway, but maybe not, if it's a popular car like say a new VW Golf then it'll sell like hotcakes, and it'll alreayd be pre-ordered and come quicker than someone making a new order, I ordered a new VW Golf Bluemotion and got offered one that had been cancelled, but it wasn't in a decent colour and had options already fitted that i didn't want so declined and waited for my new car.Thanks to all the competition posters.0

It's from a leasing company so no dealer contact unfortunately.
I simply don't understand why I can't cancel, its just a piece of paper at the moment, no confirmed build date so I don't have a slot in the first place. What would they need to shift, nothing!!0 -
Kick up a stink OP, I agree with you the time span is too long but you will need to read your paperwork carefully.

They've simple said that I can't cancel until the car has a confirmed build week which to me sounds like they're pulling my leg, i.e. get a confirmed order and then we wont be able to cancel it kind of thing. It's like they're just trying to pull the wool over my eyes0

You need to write to them, using recorded delivery, stating that time is now the essence of the contract, giving them a reasonable date for the car to be delivered to you - e.g end of July, otherwise they will be considered in breach of contract.

Its an Audi TT. Thing is the estimated delivery was June/July but I made it clear that I needed it latest end of July and asked them to be sure of their accuracy....

And of course you won't have that in writing but as maninthestreet says just send them a letter reiterating your original request (and make reference to it) that if the car is not delivered by end of July the contract is void and you want your money back asap.
This of course still leaves you in limbo.0
