Scary debt agency when never recieved a bill!

Hi There,

I used to live in a rented flat shared with a friend until two years ago this month. We rented it for ten months and never once received any communications from our electricity company. We did recieve water bills and paid those on time.

Now, this month two years later, i have a letter from a debt agency asking for £1200 from the energy used while we were living in this flat and they are threatening to visit my parents house of which they have address for. The girl i lived with now lives abroad so isn't liable. They are quoting e.on as our provider thought we never heard from e.on. I understand you cannot be billed for energy used over one year ago since July 2007.

Do you think there is a case for this? We were students at the time and so were happy to never recieve a bill! The letting agnecy always had our address to forward anything that came from them to us.

Please help! Any advice would be much appreciated.

Well, you used the electricty so you are liable to pay for it.

It is up to you to contact the electricity company with meter readings etc when you moved in/out

Whos name was the property registered in with the electric company l wonder? Was it the owner/landlord? Was it a student let type of property? If the landlord or the letting agency failed to collect the money from the tenants at the time surely it is their problem so l can't understand how a DCA would be chasing the OP.

What is the name of the DCA, has the landlord gone straight to a DCA rather than small claims court l wonder.

I would send a recorded letter to the DCA requesting proof of original debt etc

if you are liable to pay, then just offer say £10 per month

Advice? Recognise that your attitudes would be better matched by a move to the Big Rock Candy Mountains:

Good grief, I don't suppose you even have starting or finishing readings and you didn't notify the supplier of when you moved in. So the supplier is going to take whoever they can for everything they are owed, probably across several tenancies.


The best thing you can do, if you don't make it to the Big Rock Candy Mountains, is to go over to the debtfree wannabe section of the forums and find the 'prove it letter' and get the DCA to provide you with a bill. Check the dates carefully, because I think they are asking for more than just your electricity. Take it form there once you get a bill.

You are thinking of the Code of Practice for energy retail billing. Thats only if you haven't recieved a bill in 12 months because the supplier was at fault. I would suggest that doesn't apply in your case.
