Who was the executor/administrator of the estate?
You said there was enough for the funeral, was that money spent without probate being granted?

If it was less that £5000 which it probably was if there was only enough for a funeral then probate wouldnt have been needed¬¬:heartpuls baby no3 due 16th November :heartpulsTEAM YELLOWDFD 16/6/10"Shut your gob! If it was less than 5k the process is simpler but the creditors would still be entitled to their money or proof there was no money.

Hello tigtag, my brother had less than £4000, which covered his funeral. He did not leave a will and no probate was applied for. He lived in a rented housing association accommodaton. I have read on a site about 'probate, your legal rights', that myself being a administrator or personal representative, all new to me!! if the value of a persons property is not worth more than £15000 I wouldn't need to apply for probate like you mentioned. I think this has to do with someone who owns their property , I may be wrong! My brothers home was rented and all he had was the money for his funeral expenses. His accommodation was furnished and only had personal items, such as jewellery. Having said this, I am right in still thinking, I do not have to pay his council tax bill?

In Scotland funeral costs come off first before any debts, is it the same in England?
Sorry to hear of your loss, same thing happened in 2007 when my dad died. Housing Association gave us two weeks to clear house, after which they said they'd seek rental payment.
No sympathy nowadays!0
