Proving right to work.

    I'm sorry I am just not getting this, if I understand it right you are all saying that now in the UK you have to prove you have a right to work even if born there? Why can't they just check your NI number?

    Yeah, I think I will order another. I need one with my parents' details and the council dude said that is £10 or £20 for same day.

    In my last job my driving licence and NI card was enough for them. And my job before that would only accept a passport.

    If you can possibly afford to order a new one, I'd recommend doing that. The turn around is fast, and it's less than £10. Not worth the stress, plus you'll have a spare for the future ...

    We always require a passport and do not differentiate between a UK and non UK person. Without a passport we would not know their status anyway as place of birth is not necessarily where they are considered a resident.

    Because an NI number does not prove that someone does have the right to work here.

    Your NI number doesn't necessarily prove the right to work: it is possible to have one on a limited work permit, for example, and you'd still have it even if your work permit / right to work had expired. And yes, employers now face large fines if they employ people who do not have the right to work, and being born here if you are not a UK national doesn't necessarily give you the right to work anyway.

    You can't check just people you think might not have the right to work, because a) it would be discriminatory and b) some people with impeccable English accents do NOT have the right to work here. So employers should have been checking everyone for several years now!

    Well, the UKBA site seems to indicate that you SHOULD accept alternative ID from those who can't show a passport!

    Because an NI number does not prove that someone does have the right to work here.
    But in saying that I would have regarded that the simple act of submitting a NI number should then enable you to check the status of the person. This is the system used here wher unless you have lived here 5 years you need a work permit and you can't claim any benifits, an employer must submit the NI number of any prospective employee to check their status, this usualy takes about 15 minutes and is a free service.

    I just had the same panic. I have an interview today and my passport expired in December. Luckily, I've turned my flat upside down and found my birth certificate and pay slips. Only problem is they are over a year old. I have a p45, will that do? My CRB check states I was born in the UK.

    If you get out of panic mode and read the thread you will see that your expired passport is sufficient.
    Perhaps 'should be' sufficient, sounds like not everyone will accept an expired passport, but a full birth certificate is one of the other fairly vital bits of paper in the absence of a valid passport.
    The P45 won't be much help (other than providing your NI number) unless it was issued in the current year. But would not be a problem, you would just complete a P46 (which your employer would provide when you began employment).
    P46 is no use for the purpose of proving ID or right to work ...
