conveyancing fees for cancelled mortgage

I have been in the process of buying a house and have just recently been told that my mortgage company won't mortgage the house due to the non-traditional construction type. As it is the mortgage who have pulled out, what fees will I be expected to pay my solicitor? He is not very friendly/helpful/working in my best interest, so just want to make sure he isn't going to charge us for the work (or lack of work) he has done in the past 6 weeks. We have had to pay £50 upfront for coal mining search, bankruptcy search etc, do we have to pay for everything else he has done even though the house sale has not gone through?

I think it depends on your contract. My solicitor doesn't charge 'for abortive work that is caused through no fault of your own' He says he will sell on the searches etc if he can. We have just paid an upfront fee to have the searches done.
I don't think it's your fault if the mortgage people pull out.0 -
My solicitor is "no sale no fee" too.
But sometimes that means a small fee.

working for you for 6 weeks and you expect not to pay. keep the lawyer on side, forge a chemistry if you can as always great to have one you can call.
or did you go cheap and use online one?
no completion no fee means a firm who do masses of deal and they don't care if a few abort as most won't...usually the firms who cut corners....unless they charge you a little extra at the end for offering no fee if it aborts early...those sort of lawyers are good, as they are offering their clients something extra...always a good thing in this climate...value for your £My posts are just my opinions and are not offered as legal advice - though I consider them darn fine opinions none the less.:cool2:

have you spoken to a mortgage broker about finding a mortgage for the property? Did you know it was non-standard construction when you applied for the mortgage?
Unfortunately you will have to pay for any work carried out by your solicitor, hopefully you didn't instruct them to do very much without a firm mortgage offer ...0
