help advice needed please

hi I am fairly new to ebay and purchased some vouchers last week from a seller who has over 1150 feedbacks 99.7% .
the vouchers have not arrived I have contacted the seller once and she said they were posted last monday second class and should be with me soon.

Do I contact the seller again and tell her they have not arrived and ask her to refund is she obliged to do this ,or do I go straight to ebay and file a claim with them.

    The seller is responsible for getting those vouchers to you by whatever method they see fit.

    Whenever you see postage options on eBay, such as 1st class, 1st class recorded, special delivery; not one of those mean anything to the buyer. You have entered into a legally binding contract with the seller, and that contract ends when you have your goods. If the seller sent 2nd class then they are leaving themselves wide open. Postal options are only there to protect the seller.

    Also when you see statements to the effect of, if it get's lost then I'm not responsible. Again, it's the seller's responsibilty to get the item to you by whatever method they deem fit.

    Personally I would contact the seller again but be polite (I'm sure you will, you sound polite). Did you pay via PayPal? If you didn't, eBay will take a standard charge out for sorting it out.

    In the end, the seller should have a COP (Certificate Of Postage) and will be able to claim up to £32 back from the Royal Mail. You can't do this, and I say that as alot of sellers just brush their hands with it and say it's the buyer's problem. The postage contract is between the sender and the Royal Mail, and the RM won't even talk to the reciever. The postage contract is never between the RM and the buyer.

    I paid via pay pal I will contact the seller if they do not arrive in the post this morning and take it from there

    Stick to your guns as Paypal will find in your favour if the buyer cannot prove the item was shipped and tracked.
