Refund When Company In Administration

My daughter bought a pair of shoes for £30 (presumably paid cash) about 2 weeks ago, and they broke after 2 wears. She bought them from one of those stores that operate from inside Debenhams.

I'm aware that ordinarily she'd be entitled to a refund (or an exchange if she so chooses). However, although they're still trading, they are currently in administration and were in administration before she bought them.

My question is, does this affect her statutory rights? If not, what can she do if they refuse to refund/replace?

So far she's tried to return them twice but has been told that the woman who deals with returns is not there. What's more, she's been advised they'll only refund/replace on a case-by-case basis due to being in administration.

    As always, if they refuse quote SOGA and ask to speak to the senior muppet in charge :)

    Ask for the details of the administrators and put the claim to them.

    If they have now actually gone out of business (as opposed to just in administration) then you go on the unsecured creditors list with not much hope of getting much

    Thanks all for the responses.

    She has now been given an exchange, albeit after a lot of umming & ahhing, together with comments that she wouldn't normally do this ... and she also added the proviso that she can't exchange them if they break again. She seems totally oblivious to customer statutory rights; either that or she'll ride roughshod over them if she thinks she'll get away with it.
