Does He Have A Case?

Hello,
my partner has been battling with Lloyds sorting out his finances for a few years now through the complaints system and has also now written to complain about mis sold PPI on both his credit card and loan. when he took these out he was in some difficulty financially and was advised at his branch that he could take them out over the phone and if he took out the insurance he was more likely to be accepted as he had a lot of comitments at that time. Anyway he has had a letter back after sending the first one with a copy of his agreement saying he agreed to take it out and signed for it also they have checked the tape and listened to the call when he made the application back in 2005. Does he have a leg to stand on? He has paid out over 2k on the loan so far for PPI and not had the response from the credit card yet. I dont want him to give up thinking he has not got a chance against them as he is not very clued up on finances and thought as many others that if a bank advises you its in your best interest. Any help and advice would be welcome please.

Sorry to hear this, but do not give up yet, this is what Lloyds are like.
I would request for a copy of the phone call conversations and if this was not the final response - write back and tell them you do not agree with the decision, and request they reconsider, and any further information you can give all the better.
You can also say that your aware the FSA are punishing banks for not investigating complaints properly and rejecting complaints for not being investigated properly, and believe this is one of them that have been ignored/overlooked.
Give them about 7 days to get back, if you hear nothing, chase them up by email here:

Ask them for an update, if they state there is nothing more and that was final then move on to the financial ombudsman service (FOS).

Hello Di,
thanks again for your advice. I have already sent the follow up letter saying we do not agree with the decision and think they should reconsider (letter from this site). Should we have said we wanted a copy of the conversation? I just think its a grey area as he will have agreed to the PPi after previous advice to take it out at his branch in order to get the loan/ card. He had been in steady employment over 10 years so his job was not at threat he just had a lot of outgoings including his dads funeral that came unexpectadly. Anyway any pointers in the right direction to have a case would be apreciated. cheers,
