Indemnity policy + more building work.

Hi

Am in the process of purchasing a house for which there were no building applications approved. As well as the usual application to the council, the deeds contain an extra covenant as this is an ex-council property. We have managed to get indemnity policies from the current owners which cover all eventualities.

My question is how do we proceed with further building or extensions? The current bathroom is very small and we would like to extend it. Do we simply carry out any work, ensuring it is safe but without permission? Surely if we obtain permission for any work we do the council will query and investigate any work done previously which will then negate the indemnity policy and could leave us in deep poo!!! Any advice?

    I am in the same position, when was the work done and what was done?.

    Can your vendor get retrospective cert from Council?.

    The work was done in 1998. Apparently anything over 4 years is unlikely to be investigated under normal planning permission rules but the extra covenant is more of a problem especially as it is with the council rather than a private individual. The current owners already had one of the indemnity policies so can't get retrospective planning permission as the indemnity would then be void and they could encounter problems. As we have not exchanged contracts yet the problems would be down to them not us! Not easy!

    No I know, is your lender ok with this?. My solicitor said he was obliged to tell my lender.

    Yes our solicitor told our lender and they were fine. We are with mortgage express.
