I took out a joint membership for Bannatynes health club (can't remember date but it was Jan ) with a friend of mine. I payed the money into her account every month. In Aug she said not to pay her anymore as she had cancelled the DD. I knew it was wrong but I sent a letter to the club saying i was cancelling my membership giving 3 months notice. I recieved a letter from them some time later saying i owed them for 5 months membership. I cannot prove i payed money into my friends account as the bank i was with closed my account. I now have a court order to pay back 5 months worth of membership.

When i joined I never signed any T&C

what can I do to prove I dont owe them this money and can I say its illegal due to the fact I never signed any Terms and conditions

    Help Help Help

    thanks
  • I've recently lost my job due to redundancy and can no longer afford the £69.95 David Lloyd charge me each month for membership.
I need to cancel and I have read the T&C's (3 months notice - I can deal with that).

Problem is, I'm still within my first 12 months. Can I still give 3 months notice or do I have to wait out the 12 months (and cancel at 9 months/15 months)??? This is not covered in the FAQs on the David Lloyd website, or T&Cs.

Any help would be great. Would appreciate any other members who tried to/did cancel within the 12 month period.
