Not being funny Andy - but if I was you, I would've given them the extra information anyway.

    Hindsight is a wonderful thing!!

Over the past 44 years I have filled in literally 100's of government/local authority forms.

HMRC, Tac Credits, Council Tax Benefit etc etc.

If they ask to see my bank statement - I send it. If they ask to see my marriage certificate - I send it. Whatever the form asks for by way of documentation - I send it.

When the DWP ask for a sicknote, I go to the GP and send it.

No where on either the ESA1, ESA50 or letters do they ask/suggest/require me to send in confirmatory evidence from all and sundry to back up my claim. So I accept that they do NOT require it. Otherwise they would ask.

Could I ask you, who told you to go to those lengths when returning the ESA50? It certainly wasn't the DWP/ATOS!!

If they had asked, I would have complied as I do always. It has never been mentioned that I would need all of that info at that stage of the game.

It was only mentioned for the first time AFTER I had failed the medical and put in my appeal. Of course I know that I will now have to disprove the DWP decisions by producing my own evidence - a 9 month wait!!

I would do it anyway. You're meant to give as much information as possible.

Hi, I'm not having a go at you honestly, but I am intending to take this up with my MP and cause as much agro for the DWP/ATOS as I can.

All I would like to know is did you know from reading the ESA1 & ESA50 forms that you 'should' submit documentary evidence to back up your claim?

It maybe that you found out from this site which is fine and they are doing a damn good job in bringing these matters up. If that is the case, would you not think that DWP/ATOS should mention just something on the forms and letters to give claimants some chance of success as they may not be aware of sites like these?

I've not filled in an ESA form; but would do it anyway if it wasn't requested.
