Help Needed!!! Please read

Hi everyone,

I have worked in a school for nearly 10 years, for the last 2 years my role has been Safeguarding Manager. I have been paid All Year Round since 2006. Last year we got a new Head Teacher who now is in the process of restructuring the school. She wants to make my post redundant and has matched me to a new role of Senior Learning Mentor, but this is to be paid Term Time Only.

I have just got my new job description, but it is identical to my Jd now. It turns out my old HT had just changed the tiltle of the role. When meeting with my union rep i was told they cannot change terms and conditions unless the role changes but it hasnt. Can any one offer advice?

Also does anyone know the law on protected Salary?

Firstly my union is fighting to keep what i have now but we may have to go for protected salary.

I would be so grateful if anyone has any advice they can give me or has gone through a similar experience and what was the outcome.

  • If the job has changed to term time only then the previous post is redundant surely. They cant be expected to pay you year round when a post only exists in term time.

    If you turn down the new role then I would imagine its a redundancy situation given they cant really argue it is a like for like post if its completely different hours.

    I actually attend meetings in the holidays so i do work all year round. My title is Safeguarding Manager but its just another name for a child protection officer. At any point i can be contacted to attend a case conference. I dont just work with the kids.

    All she wants to do is change my title. The working hours and the job description is not changing.

    I hope i have explained myself better.

    But surely if it is a term time only post they cant make you work non term time and if they do surely overtime would be payable.

    Because of the nature of the job i am expected to attend things when they turn up. The only reason this has come about is because the school is in financial trouble and need to save money. Many other jobs are going to. The parents of the school have a petition going and the support staff have written to the MP. The local council did not pick up on the debt that was owed and now we are all being penalised for there mistake.



    The job desription is the same. So they expect me to continue the same job but for less money. Nearly £3000 a year.

    Did you get a pay rise of £3k when you were paid all year round?

    When you were paid all year round, in the holidays - how much work did you do?

    No i did not get a pay rise. I was previously paid all year round in my previous role as learning mentor since 2006.

    I attended 2-3 meetings a week. As well as working on all the paperwork at home

    And I think this explains it.
    You might have been paid out of term but 2-3 meetings a week and paperwork could easily be rescheduled during term time or delegated to staff who work non term time too

    I am afraid as far as I can tell it is a redunandy situation and you either accept the new role or take the redundancy

    A job which was year round becoming term time only surely means they would no longer expect non term time work or at least pay overtime for it hence the job description being the same wouldnt make a difference

    Have you asked what would happen out of term regards your role, paperwork and meetings. I would be amazed if they tell you they still have to be done.

    Child Protection meetings don't fit into a neat timetable of term time only. If there's a CP issue, it's generally an issue all the time, not just when the child is at school.

    I work in a similar job to yourself and in your situation would probably want to ensure that a term time contract is just that. Your employer would need to be aware that you would not work during the school holidays and you would be unavailable outwith term time. The HT or manager would need to take responsibility for doing the school holiday work - the novelty would soon wear off!!
