hi, i bought a tv which went faulty within 3 months, which was then replaced for a new one, which was the same brand. This tv developed the same fault approx 2 months after recieving it. This tv was repaired under warranty, however the tv has now gone faulty again with the same fault within about 2months of the repair. The tv is still well within the warranty period, i have rang the company up and they have offered to repair it yet again. However i would rather have a refund of a different brand of tv as this seems to be a reocurring fault. They have offered to repair it yet again but if this is a reocurring problem, which it seems to be what happens when the 12month warranty runs out?? not just that its the hassle of taking it on and off the wall and sending it back over and over again! just wondered what my rights are? hope you can help

I would check out the SOGA - the retailer is within their rights to choose whether they want to repair, replace or refund, but I believe there is a stipulation about the number of times that it is considered 'reasonable' to repair an item. I don't think there's a specific number mentioned, but if you check the wording and relate it to your case, you may find you can use it as leverage when complaining about how many times a repair has been required.0

They dont actually have the right to choose outright but in most cases its very hard to enforce another remedy so most people just accept it as their choice.
Also their is no limit, its indefinite, however any remedy may not cause "significant inconvenience". Thats it.

hey!!! just an update . . . . i wrote a letter to the head office, and they have sent me a nice letter back honouring a full refund . . .. RESULT! thanks for help!
