  • Hi yes NDL advised to set aside so have downloaded forms ready to print off to take to court Friday. How have people gone about claiming costs against Capquest? This is such a minefield!!!!

    Personally I wouldn't bother. It is extra hassle that you probably don't need.

    The important thing is to get the statutory demand set aside, and it sounds as if that is in hand. :)

  • This is what I have so far on my form 6.5 - does this seem correct to you people as you have far more knowledge than I do
    That I (c) believe the case to be Statute Barred under the Limitations Act 1980 .

    There has been no contact from myself to Royal Bank of Scotland or to Capquest during the period set out in the Limitations Act 1980
    As I married in 2003 and changed my name on my bank accounts etc I find it hard to believe that Capquest are still calling me by my maiden name which therefore proves that there has been no contact since at least 2003. I believe that I have not been in contact with the Royal Bank of Scotland or Capquest for over 8 years to the best of my knowledge.
    I have contacted Registry Trusts and there have been no CCJs issued against me in my maiden name at this address for this debt.
    As a mother of 3 young boys and a teenage son and and a husband on a low income this Statutory Demand is causing a great distress to us. We have little or no equity on our property and cannot see what would be gained from declaring me bankrupt on a debt that is well over 9 years old.
