so does that mean it will be stautue barred and i can dispute it? I will be ringing NDL in the morning but dont knoew if will be able to sleep tonight with this hanging over my head!0

Just asking a quick question here - is 'process sever' an actual job? Is somebody employed to serve papers? I'm wondering whether capquest would have hand delivered the papers to make it look more official.0

If there was a 6 year period during which you didn't either:
1) Acknowledge the debt in writing.
2) Make a payment towards the debt.
Then the debt will be statute barred.
The debt will still technically exist, but CapQuest or anyone else would not be entitled to bring legal proceedings against you, and the fact that the debt is statute barred would be a defence against any that they might try. it was delivered by a man with a resolvecall logo on his jumper and he called them and put them onto me as he gave me the papers but told them i couldnt discuss it as was on my wayto collect my children from school0

well I have called NDL and they feel it is Statute barred and given me details of forms to fill in and how to go about the process so looking good and thnak you for all your help0

Jayne: CapQuest are making a habit of misusing SDs, so depending on the outcome it might be an idea to report them to the OFT.
I assume National Debtline advised you to get the statutory demand set aside? If so, then a few people here or on other forums have managed to claim costs for doing so against the DCA.
