Thanks for the advice Robertomoir, will go back to the council today, could you please tell me if they have to notify me of when they are coming to collect as i am out at work most of the day and my son will be at home on his own which is what is stressing me out the most, if they want a really old second hand suite, table minus chairs, a bookcase that cost me 8 quid and a mirror that cost 4 quid then far as im concerned they can have em. thought about sticking em on the back of a van and delivering to there offices what you think good idea??
  • RAS, not sure why my card would not work get most of the way through then just stop, tried my sons and my mothers as well but same happened with them, not very good with things like that so dont really understand what happened, will try again today thanks

No, they don't have to notify you.

I would push the angle with the council that any enforcement by the bailiffs should be halted while your complaint about the behaviour of their bailiffs is investigated - after all the council are (remind them of this) potentially legally liable for any actions taken by their agents related to what you believe to be an illegal levy.
If you don't stand for something, you'll fall for anything
  • well been to the council, who were not willing to take any action, ended up making a formal complaint against the company and the council pointing out the above (thank you) and that they had failed in their duty of care, they wrote it all down and said they would investigate and i would have a response within 28 days.
as you are glad to say it former baliff how long do you think it will be before they turn up

Really appreciate the advice you have given me, thank you

They'll probably leave it a week or so, but I really don't know.

Now you need to contact your councillor and make the same points to them. We've had good rates of success going by that route.

I would also suggest the bailiffadviceonline website and the phone number there for advice, too.
