                    Help, first time i've used this forum, being reading through some this morning and you all seem to give good advice, so I am hoping someone can help me urgently, waiting on the baliffs turning up !! had a few issues with a dept collection company, who have refused to agree a payment plan for unpaid business rates, business is no longer running. Currently in a voluntary agreement with all other creditors, whilst trying to decide the best option an IVA or BR. Story is the baliff gained peaceful !! entry to my property last Fri despite being asked to notify me of intended visits because if i was not present my son would be home on his own. i arrived home to find a man in my living room completing a walking possesion order, which he asked me to sign and i refused, he left giving me 5 days to pay £2800. the items he listed if sold at auction would if they were lucky fetch about 200 quid, been to citizens advice, asked council to take back debt with no luck. anyone got any advice please??

            How old is your son? is he a minor? if so then the baliffs cannot gain peaceful entry by being let in by a minor.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0

            he is 17 and as usual in bed, and left back door open, not sure if that makes any difference?0

            Suggest urgent call to CAB and your local councillor, who may be able to help. Unsure re legal side of things, but Herbie21, who posts on here sometimes, but will answer personal messages and has an advice line,( sorry don't know how to post links) should be able to help. Good luck0

 As your son is a minor, entry may be a problem for the bailiff, but if someone left the back door unlocked hemay have been entitled.If you've have not made a mistake, you've made nothing0

            thanks RAS, being trying that one all morning, went to the bank and paid in the money, did my question but it now wont accept my card.. tearing my hair out now, anyone got any other ideas, really desperate now, thanks:mad:0

            If this is NNDR then the rules are pretty similar to council tax. The bailiff shouldn't really proceed when there is only a minor in the house, so I'd speak to the council on those grounds and suggest the levy is invalid.If you don't stand for something, you'll fall for anything0

 In terms of bailiff advice, that's some of the worst I've seen. I don't wish to sound rude but if you don't know what you're talking about then please be careful as bad advice does more harm than good, no matter how well intended it might be.If you don't stand for something, you'll fall for anything0
