Disabled & DWP personal advisor

There has to be consistency between ESA and IB. It sounds like that there is phasing in of these interviews as they sound the same as the one I had to attend for ESA. attend.
But my sister does not claim ESA nor IB. She is on IS for sickness.
As for the need for claims to be rigorously verified.... This happen when she applied for DLA & when she first applied for IS. My sister got DLA HRM & HRC both times without any need for reconsiderations & appeals. When she first applied for IS originally she needed a GP sicknote. He gave her a 1 year sicknote and appologised that he couldn't give her a sicknote for longer.
The DWP insist she must attend the interview. If she must we'll drag her there. I just fear she'll get there & be practically incoherent, then the DWP may turn round & sanction her anyway stating she is not "participating" in the interview. I'd like to have more faith in the DWP but they haven't shown any sense so far.0 -
I am so sorry to hear about your sister's plight. Unfortunately it sounds as if she is going to have to attend the medical. Is there any possibility of a home visit?
If she has to go, do take with you copies of her DLA award (don't assume the information is on her file), and also take copies of any consultant's or doctor's report. As far as I know they don't take that sort of thing into account BUT it is worth ensuring they do at least have the papers on file, in case you have to appeal - and who knows, you may even get someone with some common sense.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -
I gather from your reply that you called the JC & they insisted your sister still had to attend???
Well I will tell you now... THEY ARE WRONG!!
I work for the JC & am responsible for booking these type of appointments so I am 100% correct with what I am saying.
Please, please, please.. call them back - ask to speak to the DASO team manager, explain to him/her that you have sought advice &, under 'alignment rules phase 2' , your sister will NOT be attending as she is EXEMPT! The rules are clear enough on the DWP Intranet...
At the end of the day, if your sister does not attend, they CANNOT place any reduction on her benefit, if she has any type of mental health condition, without first referring for a home visit.. who will see she does not have to attend!!
Do not let your local JC bully you into attending...
Again, if you need further help, let me know!
(I hate it when JC staff obviously get it soo wrong as it gives us all a bad name!!)Oops!! Should I have posted this??? Some users don't think I shouldn't be offering advice due to my occupation!!!

I went to one of these interviews last year, the advisor was lovely, and was used to dealing with disabled people all day everyday. I was in and out within 10 minutes gave her all my hospital documents and she postponed my interviews for 6mths as I was receiving daily hospital treatment. I have since attended the first of my interviews.
All she'll need to do is go down and speak to the advisor who has set questions on screen, mine did not even mention jobs as clearly I am unable at present. Told me about courses available to me etc. There may be a learn direct course your sister could do from home etc!
Also I am on HR DLA0
