Advice needed re section 75

Hi, I recently bought a granite sink online from sinks-taps.com which was delivered buy thee in house driver. I had a quick check of it and all seemed fine, (it was delivered to my work). I took it home ( 4 miles away ) and there it stayed for 48 hours unyil my builder took it out the box to fit it. He phoned me to say there was a hairline crack on the bottom running up the side and that he could not fit it. I spoke to sinks-taps who told me there was nothing they could do as it was signed for and checked. I did sign for it in perfect condition but could not of noticed this crack unless going over it with a fine tooth comb. I have tried to claim my money back through barclaycard who have rejected it. The sink was £200 so not cheap. Is that the end of it now or do I have anywhere else to go.

    Wrt sink - issue court papers [£30, which you get back if you win] against the company and B/card.

    This tends to focus their minds [and they work out that it'll cost them much more than £200 to defend it]. If you lose you won't have to pay their expenses.

    But first send them a 'Letter before Action' [google/consumer direct/etc]....that's quite often enough to get them moving.

    Hard to prove it didn't get cracked after you took delivery, but worth a try.

    Whenever I take a delivery I write 'not inspected' on it before signing, as otherwise you are agreeing that there is no damage, and you can't really inspect anything just as it turns up.

    A delivery note (as the name suggests) indicates merely that the product has been delivered and not that they have been accepted. If there is a problem with the goods, you may still reject them, particularly if you haven’t previously had a chance to examine them in person. With some items you will be asked to inspect the goods there and then and sign a form to say that they have arrived in satisfactory condition. The law states that you should have reasonable opportunity to examine the goods for yourself, so you could argue that ‘there and then’ is not reasonable and opt not to sign the form. You should however look at the supplier’s Ts and Cs to see whether they have imposed any time limit on reporting faults – although in line with the law, this should be a reasonable time!

    The t's and c's state I had 24 hours to report any faults only if delivered by courier and not in house, I only checked it properly 48 hours later.

    Can you be sure that the crack didn't happen whilst you were transporting it? Not saying that it did, but presumably that's what the company are suggesting?

    Yes that is what they are saying, Im pretty sure it didn't I only took it ten minutes up the road, they brought it all the way from leeds to essex! and it was stacked on top of othe boxes.
