won medical appeal

hi just wondering if you could help i have been on esa since dec 2008 had a medical on 24/08/09 for panic/anxiety attacks was sent a letter on 23rd sept 09 saying i didnt get enough points to qualify they gave me 6 points so i failed recieved appeal on 20th oct 09 reconsidered on 14th dec 09 still wouldnt change amount of points went to tribunal recieved letter on 5 feb 2010 to say they was now dealing with it been on esa throughout and recieved a letter 15th may 2010 to say i won appeal and infact had 18 points can anyone tell me what i need to do now and what happens in terms of backdating etc is it from sept 09 or from the end of the 13 week assesment period

It will be from the 92nd day of the claim. Be prepared for it to take a while though as arrears of benefit are less of a priority than regular payments or fresh claims being processed.

IIRC I got my money within about a month of the appeal.

spoke to somebody today one minute they aree saying it will be backdated from week 13 then thay are saying because ive been on benefit since 2008 it may be from when i failed medical in spet 2009 can they do this

No, the appeal was against the decision made that you didnt score enough points at the medical, that is the decision that has been superseded and will take effect from the 92nd day.

ok thank you ill just wait for a letter from them which they have told me could take 2-3 weeks for them to recieve confirmation from the tribunals service then they will adjust my benefit and it will be down to the decision maker as to wheather they backdate it from 92nd day of end of sept 09 what i cant understand is how it takes them so long to sort this out but as soon as you fail a medical within 3 days they are writing to tell you that you are no longer entitled to the esa benefit but when they have to pay you back money it takes forever lol
