    Thanks LL,

    Yes I live with my folks. It is weird as I have been supported by them for the last year. That said I haven't bought any new clothes etc. I just eat, surf the net, have a wash ... very basic as I care for them.

    for the sorts of debts you describe, the bailiffs are instructed via the courts and you shouldn't have a real problem with what you are saying here. If you are taken to court and bailiffs are instructed then this will take some time to shake out - more than you might think - and bailiff enforcement action for this kind of debt isn't that difficult to delay. I see no reason why you can't squeeze in a BR in that time.

    If the hearing is next Thursday I can go away next weekend and not worry about then turning up while I am away until the Tuesday?

    I'd be surprised if they turn up that fast - but never say never.
    If you know bailiffs have been instructed there's a form you can fill in to halt their progress, anyway.

    Sorry br_man,

    I have been out of the office and just got your PM.

    The first thing that you need to do is to get your income in order. Finish off your paperwork and start claiming what you are entitled to. Second, open your post and sort out who you owe money to, and how much you owe to each. You need to have an accurate balance for your bankruptcy forms.

    Once you have done this you can start filling the forms online at https://www.insolvencydirect.gov.uk/isolv/

    Regarding the Council Tax, this will be included in with your bankruptcy (along with any fees incurred by the bailiff).

    Your property will be dealt with by the Official Receiver, so any shortfall will also be swallowed by the Bankruptcy.

    Again, sorry for the delay in responding to your PM. Why don’t you call our helpline, it is usually possible to have an appointment straight away. You will be able to go through Bankruptcy in detail with a counsellor. You will need your income, expenditure and details of debts to hand when you ring. The number is 0800 138 1111.

    Thanks for your replies on my thread.

    Had my head back in the sand the last few days. Hard to deal with but needs must so i'm focussed again.

    The Court date is this Thursday for the Council Tax bill. If I miss it then the bailiffs will be in action. You mention that I can send them some letters to stop this.

    How do I action that? Once Thursday passes the bailiffs send a letter and I can send some template back to them to show I am aware of legal rights?

    I will crack on with that right away. It's very scary. I feel like i'm doing something wrong and it's hard for me to action. I know what needs to happen deep down, but it is just doing it. I'm such a wimp.

    Just a couple of questions - have the council been writing to you at your parents address or does the post still go to your old flat?

    Also how long was the flat empty? As I know they say you owe 12 months council tax but surely you get 6 months expemption on that?

    I know it's easy to bury your head, but you have made a huge start to this and you can carry on.

    Have you still got your weekend break planned? If I was you I would use that time to really chill and relax and then when you get back really get your head down and get started.

    I'm not sure but it maybe an idea to go to CAB and chat with them especially to see what allowances you have missed out on? Maybe make an appointment for when you get back.

    Great words af advice, I do hope things start to get better for you, at least you seem to be heading in the right direction now that is the main thing :)

    I have had my problems over the last couple of years and am familiar with the feelings you have, it will get better I promise take eah day at a time, keep posting on here there are some wonderful people on these forums full of knowledge when it comes to things like this.

    You have a great weekend away and try not too worry things will get better :)
