Well I had another letter from the Council today with a court date. It reads as follows:

Complaint has this day been made before me the unsigned on behalf of the Charging Authority for the District that you, being a person duly assessed and charged as set out above, had not paid the said full amount of the Council Tax by the date of Complaint.

You are hereby summoned to appear on 27/05/10 at 10am to show cause why you have not paid the sum which is outstanding.

Can I do all that is required before the 27th or can I set the wheels in motion and notify them that I will be going BR in the next few weeks?

    Hi

I'll give you a bump up as I am not too sure myself how long it takes - I know you can at some courts just turn up and at others you need to make an appointment.

The form I think is quite in depth and you need to make sure you have all your paperwork in order (someone more in the know will be able to shed more light on this for you)

Also I think you really do need to have shown that you have sought advice from one of the debt charities. As I have suggested earlier maybe you can get an appointment at your nearest CAB office and they may also be able to give you some advice with your form.

I also think you can do you form on line and I hope some kind person will post the link for me.

Hope that helps and as I said someone with more knowledge than me will be along soon

Thanks for the reply LL. I appreciate your help.

Could I speak to one of the CCCS guys and show that they have advised I go BR and will be doing so? Would that stop them sending the bailiffs?

I don't think that would stop the balliffs - Hopefully someone with balifff knowledge can advise.

Whatever happens when you do go BR you have to show the court that you have sought advice.

I think as you want to do this quite quickly and as you have the threat of baliffs hanging over you I would possible go to your local CAB

    good luck

"being a person duly assessed and charged as set out above,"
    what crap!

the wording of that letter sounds very mellow dramatic, i know some sols and dcas can and do try but that sounds like its from a movie script .Next thing they will be saying will the dfendent proceed to the electric chair.

Dont worry br man once you and if you go br? its game over for them. Not a 100% but i think council tax can be included in the br list.

    Thanks Single and Out

Can I act in time to stop that bailiff as I go away to the Lakes for a few days over that w/e and I am worried that they will come round and collar my folks?

My folks aren't in any danger if I go BR?

I may have found an answer to my issue re council tax from nosing around on here

    bailiffadviceonline.co.uk/counciltax

So judging by that I will have 2 weeks as of the Court Date to get it all done and dusted before bailiffs appear.

I also don't need to appear in court by looks of things.

If the bailiffs are appointed and have fees, can I add them to the Bankruptcy or is it not as simple?

    Thanks for your help all.

Just a quick one.. on your SOA you can't have money for presents or entertainment.

Can i assume the rent you are paying is to your parents and that includes things like TV licence/gas/elect/council tax?

Glad you found out some info on Baliffs - and sorry can't answer your laterst questions but sure someone will be along soon who can help.
