Home doctor visit from ATOS

My GP supported a home visit but ATOS turned it down flat. Yes, I can get to the shops, but not every day and it's seldom planned in advance because my condition is variable.
Funnily enough I did get a home visit for my DLA medical AFTER I attended TWO appointments at the medical centre which did not go ahead due to ATOS' incompetancy. For one of these I had to be hauled there drooling in my wheelchair, the other one I walked in - definitely variable!Eat food. Not too much. Mostly plants - Michael Pollan

No matter what ATOS say the final decision on attendance is down to a DM at the DWP. FACT!!!!
ATOS has absolutely no power in this respect to force anybody 'with good cause' to a medical. They are acting for the DWP as I have already stated and therefore governed by the same rules as the DWP.
All ATOS can do is tell the DWP that you have failed to attend. This gets passed to a DM along with any supporting evidence you have provided (doctors/consultants letters) supporting you case for a home visit. If the DM feels that this evidence is not enough they will writes to you asking for further clarification on your reason for non attendance. The DM then bases their decision on this evidence with reference to the guidance laid down by the Secretary of State.
Therefore any request for a home medical has to comply with the DWP rules on one as it is ultimately the DM at the DWP who decides. :T
ATOSs is only there to proved a DM with information. ATOS does not decide claims a DM does. A DM if enough evidence is provided can and will decide a claim for ESA not ATOS. If there is not enough evidence then ATOS is requested by the DWP to get more.0 -
Well that's not the response I got from the ESA or DLA helplines. It would be helpful if you could tell them to do this in future
