Easyjet damaged my baggage in fragile

On a recent return trip to uk on easyjet airline they damaged by baggage in fragile. i Completed a P.I.R report at the airport and sent to easyjet.
There reply was that they are not responsible for damage in fragile; effectively denying any liability for damage.
I know there are just trying to fob me off, does anybody have experience of damaged baggage by a airline before i start leagal proceedings.

Were you forced to put the fragile item in your luggage e.g. recent critical terrorism allert? or did you chose to.
Unfortunately I believe that their liability to luggage is quite restricted by some convention or other.
Can't remeber the details but Warsaw spring to mind.
You could google or look at the Terms and conditions on your ticket or their website.
Did you have either travel insurance or home insurance for personal possessions outside the house?
Unfortunately I think they might be right so you may have to fall back on the insurance.0 -
Did it go limited release which means they accept it at your risk? They usually do this with buggy's etc so that if they get damaged they arent liable.
Can you claim off your holiday insurance.
Hubby works at Birmingham airport for one of the handling agents so if you need any help or advice etc let me know.0 -
Any more info? I mean, was it a vase or the like? guess it could probably have been wrapped better - bubble wrap is your friend!
Suppose if there were fragile stickers on the outside you might get something but if there wasn't I'd doubt it - T & C probably give a whole host of terms and conditions about limited liability.0
