Faulty Tap B&Q

Bought a tap from B&Q's own brand in December 2008, it was installed by me around March 2009 in our new bathroom.
The tap has developed a faulty, leaking cartridge. It came with a 5 years "manufacturers warranty" and a card in the box with a number to call.
When the tap developed the leak, I tried to access the cartridge but couldn't as the grub screw which holds the handle on is stuck, our plumber also had a go and couldn't do anything. Called the number on the card, explained I had a faulty tap etc...
All they're going to do is send me another cartridge despite me telling them I can't get into the tap. Just kept saying our technical department will guide you through the install....!! frustrating.
Can I just not take the thing back to B&Q and get a replacement? I have the receipt, warranty card but no box.
