red path me... yellow path was the trolley man. 98% of people coming out of the mother toddler car park turn right to leave, I turned left, he was acting purely on the assumption I was going right and carried on going straight I think?my 'u' btton is broked :rolleyes:0 -
I think I am going to suggest to them that if their trolley carts are going to use the roadway then they need to learn basic 'biking' style hand signals to alert drivers to their intentions. I was ahead of him when reaching the junction so it should have been up to him to determine what I was doing and to stop and wait for me to manouvre, not carry on willy nilly and do as he pleased.my 'u' btton is broked :rolleyes:0

yes, like all the cars before me I overtook him, I reached the junction well ahead of him, I was signalling left. As I was stopped he had more then enough time to come up along side me and see that I was going left... he would have approached me from behind them moved alongside me so there is no way he did not see my signal unless he was not paying attention (using his mobile as earlier stated) he claims he was going too quickly to stop when surely common sense dictates that he should have been stopped or slowing down as he approached a junction and paying attention to what the cars were doing. As he had to come along behind me he should have been more cautious as to what I was doing... the trolley machine is approximately 2 meters in length... putting him at the controls at the back of it he would have to be at least a meter behind my car to hit the rear passenger door.my 'u' btton is broked :rolleyes:0

It seems that you were both intending to turn left. As he's on the inside, you really should have given way to him I'm afraid. In effect what you have done is cut him up. Imagine if he had been driving a scooter or a motorbike - would you have turned left across him then? And you must have been positioned towards the right of your lane to allow him enough space to get through on the inside e.g. it looked like you were turning right from your road position, and you had only just overtaken him.
The store is now slightly different with a big metal parking structure over the main car park which is not seen in the google map pic. It means there's a bit less space to turn left or right from the disabled/child and parent car park. There's no straight on option (as the OP draws in their diagram) as if you went straight on you'd no longer be able to proceed straight on through the carpark if there were no parked cars, you'd hit a metal barrier.
This is probably a 50/50 responsibility thing if insurers got involved. Don't forget you can always report the accident to your insurance company and have them do all the work of trying to reclaim the money for you.0 -
he stated he was going straight to collect the trolleys along the main roadway that people place along the sides(also a road hazzard in my view as it forces cars into the right lane) Theres a space along the metal over car park that they often travel along right in front of the on and off ramps, this is thier main route out of the mother toddler, they always follow the road, go straight across at that junction and then go right. They often do this from the inside lane, so effectively he was trying to make a right turn from the inside lane after coming up on my left. I was able to overtake him and get back over, he squeezed in alongside me which he should not have done really as there was obviously not suffient space to do so as I had barely started turning when my car was impacted by his machine. If his intention was to cross over and go right he should have been towards the right of the lane not riding along thee left as he was... as there is a slight inturn in the areas where te bikes park there would be no need for him to be that close to my car if his intentions were to go leftmy 'u' btton is broked :rolleyes:0

I also agree that in essence, you cut him up unfortunately. It looks like its a single lane, albeit a wide one, and you overtook the cart and pulled back in.0

Seems to me that the letter you received is a standardised response to most car-park prangs (i.e. caused by other customers). I would reply along the lines of, "Thank you for your e-mail, which I acknowledge is a standardised response to similar incidents. In my specific case, the accident was not caused by another customer but by an employee of Tesco as you acknowledge in your apology. I intend to take this further."0

here is a street view picture with the new over car park that does not appear on the original, the trolley cart man was attempting to travel to the area circled in red straight across from the junction. this is a former parking area and is now home to a path and usually a large collection of trolleys.
I appreciate the fact that I did overtake him, but I did this completely and fully. Drivers are often forced to overtake the trolley machines in this area as they are often parked here for extended periods throughout the day, as well as a usual line of cars empty or idling as people park along the front of the disabled bays to use the cash mashines ( blue area on the left of the picture)

If it is classed as a public highway, should the buggy not be displaying tax disc, number plate etc and have insurance for such eventualities?
Sounds like they are trying to fob you off. Contact head office direct, sod the middle man!
The car park won't be adopted public highway0
