Contribution-based Jobseeker's Allowance

The job centre have put my partner onto Contribution-based Jobseeker's Allowance.
However, we have just realised that its based on how much National Insurance you have paid in the last two tax years.
But he hasnt been working in the last 2 years. Hes been in full time education.
Have they put him on the wrong Job Seekers??

They look at the 2007/8 and 2008/9 tax years.
If he has not paid enough NI in these tax years he will not be paid conts based JSA and would need to claim income based JSA.0 -
Okay thank you. That might make more sense then, as he was in the RAF until May 08, after which he was injured and left.

And if he went on income based JSA he wouldnt get a payment as such as your income is taken into account0

Well if it isnt declared its fraud and if found out will be made to pay back all the JSA they recieved!0

errrm okay well they have already taken all my student loans info and took my notification as evidence so they already do know about me and my income!
So no fraud going on here. I dont see why you must jump to conclusions like that?!
I was just asking for some genuine help and advice. I'm not trying to commit fraud of anykind.
