disapointment from inland revenue

Hi there, just wanting some advice on child tax credits
Basicly, My 16 year old son came home to live with me on jan 1st 2010 ( lived at his father's house for 2 years and has a residence order in place, kicked him out of the home) i was on esa due to ill health. i put in a claim for child benefit and my ex partner did not challenge this. claim warded 17 Feb 2010. i put in claim for child tax credits 3 march, ( new claim as my one previous was stopped ). They said my son was on another claim ( his father ). i sent all proof that my son lives with me, ie child benefit letters, school letters, social services proof letters and yet today i was told that child tax credit had been awarded to my son's father. me and my son live on £60 a week. im shocked and horrifed by this. iam looking for work, but my son has EBD, conduct disorder, Depressive disorder. has been arrested numerous times. and self harms so is hard to find a job that will let me leave on 1 minute notice. My son DLA was turned down because his specail school reported he was having " a good day" s this is gone to appeals and wont be likely to hear anything till end of august. Also now iam due to go to court for eviction of tenency.
Please need advice on what to do.. to me it seems inland revenue is openly allowing and even helping somebody to commit fraud

Appeal against the decision to award ctc to the father. Its not just based on things like who gets the child benefit, but questions are also asked like who does his washing, who cooks his meals etc. If its joint custody, sometimes the "wrong" person will be granted tax credits, but thats just life. If its sole custody ie you, it should be easy to prove. Call the helpline and ask them for the relevant forms for this - his father will also recieve the same ones by default, and then its in the lap of the gods to decide. If he doesnt reply, you will automtically get the tax credits awarded.0

my son lives with me 24/7. there is no joint custody.. even in social services letters show my ex partner say " i do not wish to see, talk or any other kind of comunication with my son"
I did ask inland revenue for an explination and all they said was a bit infomation which my ex sent them after the deadline for return of forums0 -
Gather all your paperwork up and put your newly elected MP to the test. You have custody of the son, you receive Child Benefit for him. Are you in receipt of Child support for him - is he still in school? From what you have said here, your son's father is fraudulently claiming child tax credits with the assistance of child tax credits themselves! Get in touch with your MP now.0
