Warranty Returns

Can I expect to get a refund for shipping costs when I have returned an item due to a warranty claim and the claim is upheld?

Sent back cycling wear to to different online retailers and one has refunded the shipping costs but the other is saying they won't.

It's not my fault the second item has failed in it's warranty period so why should I have to foot the bill for shipping?

    They should be refunding the shipping too - it's not your fault the product is faulty, it's theirs!

    Not sure what you mean by "its in it warranty period" however if the other supplier has refunded your postage I'm assuming it is within a reasonable time of purchase so refer them to Regulation 14 (6) of the Consumer Protection (Distance Selling) Regulations 2000 (SI 2334)

    This refers to where goods are returned as a right due to a breach of a term implied by statute (specifically Section. 14 of the Sale of Goods Act 1979), the rights, given by Regulation 14(5), of a seller to require the buyer to bear the cost of a return is do not apply.

    That means they have no right to make you pay the postage irrespective of what is in their terms and conditions if the item is returned because it it faulty

    item has a 2 year warranty and has failed within 8 months

    item is a pair of waterproof gloves that leaked like a sieve in a downpour so they have gone back

    Ahh I thought you were returning under SOGA after a couple of weeks. You can try that but given the time and the fact that after 6 months its up to you to proof fault it might not work...
