Mobile Phone Contract, the phone , etc

I took out a new contract with Three Mobile on April 28th 2010.

I had previously had an account with them, but the service was not fit for purpose as I was unable to use my phone becasue Three had chosen to switch off and take out a mast near my home.

I contacted them in December and they cancelled my contract for me.

April 28 2010 I was assued that the coverage had improved, I had no reason not to belive this as when the coverage was present the service was good.

On getting my handset home I found that there was no coverage at all despite their instore map showing that there was...

I contacted them and told them that I felt that I had been misssold this contract, they have agreed, and have canceled my contract for me.

However they have not come to collect their handset, it has been two weeks plus now, I need to know what I do and what I can do.

I have conacted them several times, and they tell me they are sending me packaging to send it back to them, nothing has arrived. I have told them this.

I have nowhere to send it, or take it.

Lastly if they dont come to collect it, can I keep it? What are the legal rights, implications of this?

    write to them recorded delivery stating they have 30 days too arrange collection of the phone or you will dispose of it.

    TBH though they never collect them, what would the do with it? its not faulty so cant send back to supplier and its used so wont be able to sell on. Its cheaper for them to not collect it to save courier charges.

    I just had my phone "repaired", its a known software issue and cant be fixed as its in all the software, they sent it back and i got a replacement phone and they said, just keep the old on, its useless to us now. so i can sell it on lol.
    Back by no demand whatsoever.
