    £300 ish for cd and some prints. £150 paid upfront rest when collect.

    then offer came through for free cd - which if had been told would not have paid £100 ish pounds for. this let to dispute etc and left with company to resolve. Did not turn down offer of free cd, explained that we would rather have the free cd from hosting party - they claimed could not do this.

    Have not heard from them (for 2 years). complaint is we have paid £150 for nothing. not received any goods from them or heard from them since.

    Have you actually even contacted the company RECENTLY to ask for the CD and offer them the £150.

    If they've lost the CD, then you can think about small claims court. If they have the CD, cough up the money (or forget about it).

    I don't know how it will work out with the 2 years gap, as you left it with them looking into it and to get back to you might work in your favour.

    Was there a time limit in the contract for collection? If there wasn't than providing there isn't a rule in contact law with regard to elapsed time which I don't think there is, and they can't produce the product than you should get a refund.

    Its the digital world, Its not hard for a company to keep a CD or other digital record, so I doubt they would of deleted it.

    IF they have the photos, than you owe them the money, it doesn't matter if another offer was made after the fact, it would be a different contract, the second offer didn't change the terms of the first. So you can pay the £150 and collect the items, or leave it as they don't appear to be bothered. You don't have a right of refund because of the second offer.
