    I was in this exact situation, my mother bought a house and then rented it out to me. The HB paid her with no problem, and someone also tried to grass me up but were told that it was all legal :)

    If the property was bought for the purposes of letting it out, was then let straight to you, and you either paid rent or applied for HB straightaway that would have all the elements of a commercial tenancy.

    The difference between that situation and the OP's case is that they have been living rent free. This would never happen with a commercial tenancy, or if it was happening the LL would take steps to remove the tenant from the property.

  • What actually happened was my parents bought it and applied to demolish it (it's in really bad nick) so they could rebuild a suitable house for their ongoing retirement. They had problems with planning and had a rejection for the design. Then dad got ill....then they lost money in a pension...so they can no longer afford to build...there is no way it would sell...it was lying empty, windows were broken.
    Meanwhile I lost my job and went self employed they said we could live there in the meantime to stop squatters etc.
    It worked well till now...
    now they need an income...
    only since our books were submitted in Jan I knew how badly our business was going (explains why I was chucking up - denial).
    Anyway so you think i should move out then?

    Is there any way you could meet your parents in the middle - could you afford to pay them something, enough to cover their bills but not market rent? For them to market it to a proper tenant would mean them having to comply with landlords regs - it may be cheaper for you to give them something than for them to do upgrade the property.

    Could you take some part time/ employed work, to increase your income?
