Advice please!!

Hi,
I have sent the first letter to my lender, about 8/9 weeks ago. They have written back twice, saying that ' to be fair to all our customers, complaints are dealt with in the order that they are received', and that they have not yet investigated my claim.

Do i be patient and wait for a letter either rejecting my claim or with a cheque:), or send the second letter shown on the website now?

    Hi Paul and welcome

    Normally you write to the ones who set up the finance, and they have 8 weeks in full to respond.

    As those weeks have passed you should be eligible to take your complaint to the Financial ombudsman service (FOS), but as they have wrote back to inform you where they are, they must be dealing with it, or will be.

    So if you want to give them a little longer, say another 14 days, and if you hear nothing, either continue to complain to the FOS or send them a reminder to say if you hear nothing of a decision on your complaint by 14 days of this letter, you will continue to complain to the FOS.

    However they should have still enclosed the FOS details with a leaflet to let you know your still able to take them to the FOS.

  • i would wait the suggested 14 days as stated above, once the complaint reaches the FOS you could be waiting upwards of 6 months

    just got a letter from the bank:

    'I regret to inform you i am not yet in a position to provide you with a full response'
    blah blah blah
    'I will be aiming to provide you with a full response by 10 June 2010'
    blah blah blah
    'i very much hope you allow me the opportunity to investigate your complaint, you have the right to refer this case to the financial ombudsman if not satisfied with the progress made'

    This will make it approx 12 weeks from when i sent the initial letter to them. As they have stipulated a date, i will give them until the 10th then send the second letter.

    Will keep you posted

    Thanks for your update.

    Just as long as the 8 weeks have passed, you would then be eligible to take your complaint to the financial ombudsman service (FOS), but it may be worth giving them a little longer anyway as I assume they have backlogs of these complaints to deal with.

    Fingers crossed for a good outcome.;)

    Hi, was this the final response and had they enclosed details of the FOS as well?

    If not then you should be able to write back and ask them to reconsider, but otherwise, yes complain to the FOS.

    The FOS are so bogged down with these claims due to FSA not flexxiing their muscles and sorting the banks out, they brought the world to it's knees, they have ripped thousands of people off and are still calling the shots???
