Ebay fraud

Hi people please can you help 2 years ago i bought a car off ebay for £2800 and it never showed up, stupid me i payed the person direct to his bank account and the person never returned it. i went to the police and the person was found that he defrauded few more people and at the end of the two year and a final court trail found him guilty but i never received a penny back and the scum received only 200 hour community service. is there any ways that i could possibly get my money back like maybe taking him to small claims court but i dont have a clue so could you please help me many thanks...

    Was any mention of him paying back the money in court? Normally if a person has assets I thought the court would require money to be paid back? If he has no assets, then small claims court can't get you the money, however if he has assets its a reasonably simple process.

    Thanks frannyann in court he was forced to pay every one else compensation apart from me i do not know why that is im waiting for the police officer to get back to me tomorrow. i believe he has a car im not sure what else i was never invited to the court as they said there had al the evidence they needed. does this help thanks

    I'd see what the police say about why you were not included in the compensation. If he proves that he needs the car to work, they won't force him to sell it. It is a very simple process to put a claim into the small claims court and can be done online, the fact he has been found guilty of taking your money helps as then you won't have to prove that. You will need proof of the money going into his account and it will be helpful to have the advert too.

    Is this a police issue or a civil issue? I'm not sure how this works but OP can you not speak to the clerk of the court and get a copy of the judgement (or something)?

    As the case was tried in court as Fraud, I would want to know why others where compensated for their losses but not the OP. It appears he is in contact with the police about the criminal case, they may be able to expand on why the OP was left out. As he will incur (allbeit small) costs to go to small claims, which seems unfair if others were compensated.

    Good idea about getting a copy of the judgement!

    Yes that was what I was hoping asking for a copy of the judgement would ascertain. The OP might find the court never even charged him with their car?

    hy guys thanks very much for your help i spoke to the police officer 2day and he said he was found guilty on my case but does not know why i wasnt awarded any thing. he suggested speaking to a soliciter. but would it be easer for me to go through small claims or paying for a soliciter. the officer said he will give me all the eveidence i submitted also the courts so what should be the next step many thanks guys

    Contact the court (or judge) who found him guilty but didn't award the money, and ask for an explanation why?
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    Get the evidence from the police, also see if the judgement mentions why you were not compensated. Then we can consider it further!
