There is a bit if difference between NIDdy's thread and the stuff on default etc.
The law on CCAs changed in April 2007, largely because of pressure from creditors who relasied the mess they were in. So for the most part it is CCAs issued before 2007 are going to be unenforceable.
Creditors cannot do anything much to change what was written before 2007, although some try, like the recent report re Cabot.
So open forum discussion can educate creditors but they still cannot do anything to rectify their previous mistakes.
The whole area round defaults is much more difficult because these are being issued like confetti at the moment. So every time a default letter is challenged in the courts, the DCAs can learn more and more about how to issue them correctly. You would actually think they would have sat down, read the law and worked out how to issue a legal documents? Much the same as Cap 1 who pretty much failed to issue any legal CCAs as far as I am aware - seen one on here and lots of duff ones, or landolrds who cannot issue a valid section 21 notice. But no, they issue the same mistake time and time again, MBNA being another one whose CCAs are often faulty.
So the greatest opportunity to challenge DCAs comes from keeping information about the minutiae private.
We are not saying you should not pay your debts, just that you do not have to accept CCJs or charging orders.If you've have not made a mistake, you've made nothing0 -
