bailiff advice

hi everyone, i need some advice, my husband was very unluck last year as he got layed off twice. the council tax bill wasnt payed in full and there was a small amount still owing, i had set up a direct debit, & was paying it off. the amount is £173.50. i had a letter last thursday stating there was a problem with the payments i contacted the council. i was told for some reason the dd was not going through, i made a payment on the phone to cover this month charges & took the new dd form straight to the local office .all was well, untill last night when i had a letter posted through my door from swift credit services, saying i must pay in full in the next 24hrs.
i phoned the council & was told i should have been made aware of this last thursday,& all they could do is appologise, but to contact swift & now pay them.
i did, only to be told unless i pay in full straight away, i must have a bailiff attend again, & sign a levey of goods agreement, which will cost me another £40 odd pounds. im shocked because i dont have the money straight away i must incure more charges, can they refuse to arrainge a payment plann without further cost's to me ?.
all i want is to pay half today & half on friday when we get payed , without incuring more charges, last nights letter cost me £22.50.
what makes me more cross is if i hadnt of payed the council last thursday i would have the cash to pay this now. Ive kept in contact with the council, made them aware of the situation throughout, & now this, and just to make it even worse the dd wouldnt go through as my bank has changed its name to santander ! what a mess !! any help would be gr8 thankyou nessynoo

This is all complete cobblers; the bailiff is lying to you.
Legally he has no right to enter your house unless you let him. He can bleat all he likes but you can pay him what you can afford.
he is allowed to charge £42.50 for two visits and no more, unless you let him levy. If you let him levy, he will then add hundreds of pouns of van and enforcement fees.
Do you have a car?
And can you find out who the local councillor is for your area?If you've have not made a mistake, you've made nothing0 -
I'm sorry to hear about your trouble nessy but I don't know much about bailiffs.
I've read of a website which may help http://www.bailiffadviceonline.co.uk/ and there is a member on here (RobertoMoir) who used to be a bailiff and may be able to give you advice. Perhaps you could send him a pm.
I'm sure someone more knowledgeable will be along to offer you more advice soon.0 -

thankyou everyone , ive looked on variouse sites, they give basic advice, but dont answer can they refuse my offer, without the levey ? . Its so frustrating all i want to do is pay it & get it sorted, but im not willing to give them any more fees . yes i do have a car ras, its in the garage being repaired, was picking it up today, but dealing with this is more important.

They can only levy on your goods if you let them in. So don't! Talk to them through the letterbox, keep all doors and windows shut, and move your car to another street so they can't tell it's yours.
Then just pay them what you can when you can.Unless I say otherwise 'you' means the general you not you specifically.0 -
Can they refuse your offer? Certainly - but they'd be daft to. Contact your local councillor and tell them what has been happening that you PAID the council when they told you there was a problem - you were happy paying the council by installments and had NO warning it was being passed to a bailiff - all you want is for the debt to be taken back to the council and you to continue to pay them, less the money paid to the bailiff...
Stick to your guns and if you can go in person to the council and request it too - they may say they can't take it back but they can if they really want to

Just phoned my council & asked for them to take the debt back & il pay them . I exsplained i didnt know it was being passed to bailliffs ect, & fingers crossed i may have a result.
The supervisor is on lunch till 2pm & she will discuss it with her then. Im hopefull, as ive made it clear im not willing to pay all the extra charges, as not only did the bank change there name, but i was just told, the council changed there system & its caused no end of dd to be refused !!!.

Im over the moon!!!! :j, ive just spoken to my local council and they have excepted half the payment today, & a promise of the other half on friday !!.
ooohhh the stress is just melting away !!!
all charges from the bailiff's have been dropped .
A big huge thankyou to you all , if you hadn't advised me i would have allowed them to come do the levey and incured the extra charges .
