Capital ONE are stalking me - Please Help!!!

Hi

HELP!!! Advice please!

I have just got off the phone from Capital one. They ring 10 times per day if I do not answer the phone. When I do answer the phone I have the same conversation with someone that I had the day before.

I have told them that I have done an on-line assessment with the CCCS who have advised me to pay £1 per month until my financial situation improves. I sent them my income and expediture form after I have done that and they replied with a pack as thick as a book asking me to complete that. Which I did. They say they haven't received it and every day they phone me to tell me I am over my limit and every day I tell them the same story m(25 mins later) where they promise to send me out another one (which I never receive). Half the time they do not even have a record of the conversation I have had the day before. I think the operator does not record it as they must be targetted to get money from each call or something so it would effect their figures that I do not pay them anything over the phone.

:eek:ARGH!!!! They are driving me to distraction and I don't know what to do!!!

I only owe them £150 which believe me if I had I would prioritise and pay for my sanity!!!!!:( I owe other companies 20 times that amount and they accept what I tell them and have set up the payment plan. What is wrong with them???

Has anybody else had this experience?

    Hi

Have you sent them the telephone harrasment letter or the letter asking them to remove your number from the system?

There are 3 letters (of increasing steps) see the links in this post -

No, this is brilliant thanks. I will send straight away. I requested that they remove my number from the system but they refused and said they couldn't do it.

    Thanks so much.

This is why they keep phoning you! Many people will pay their most troublesome creditors first.

Send the letters but in the mean time if it's getting too much, just unplug the phone!

Unplug the phone, give the wrong answer to the security question or use the following, which I copied from a thread on here but can't remember which one to get the actual link.

"I have on numerous occasions, informed you that I am unwilling to communicate by phone and also notified you that any of my phone numbers are to be removed from your systems. The frequency of calls received from you, and each call, has been recorded for independent adjudication, this call is also being recorded.

I hereby formally place you under notice, (section.7 Data Protection Act)and demand you take this verbal authority to cease with immediate effect, from calling me and also update your records to reflect my request to remove all telephone numbers listed.

This is your final warning - write to me."

I think it was probably from never-in-doubt's unenforceability thread.
