new dress worn for 4 hours

Hi, Has anyone any advice,

I recently bought a £200.00 dress for my Brother's wedding, I bought the dress in a local boutique, its boned & corsetted on the upper half of the dress, after about 4 hours or so I felt this sharp pain in my arm, it was the bone on the dress had come through the dress, I had to leave the wedding early as i could not carry on wearing it, I called into the shop the next day to ask if they could repair it or what my options were, I was pleasant & I wasn't demanding a refund considering what had happened, A week later I was still waiting on an answer so I decided to call them instead,
I was told they had consulted the manufacturer & they would not take it back cause it had been worn & suggested putting electrical tape round the exposing bone as this is how its fitted onto the dress, what a complete joke, there suggesting I repair the dress, I'm not a seamstress,
Any advice welcomed, I AM NOT LETTING THIS ONE GO, .

    If the dress is faulty (which is quite clearly is) then you are perfectly entitled to ask for a repair or a replacement. I think they are trying to fob you off - 4 hours wear out of a £200 dress makes it not fit for purpose. Have a little read of the sale of goods act and then go back and stand your ground with them.
  • I've been searching the internet for advise also, I now know the manufacturer is not liable, I wouldn't mind so much If I was looking for a refund, I just want it repaired, When I go back to the shop to stand my ground & still get no joy, what can I do,

    You definitely are entitled to a replacement.

    If they won't budge, tell them you are going to contact trading standards as they are breaking the law. They can't take away your statutory rights. Or contact trading standards first and see what they suggest.

    I bought my OH a fleecey jumper from Next and after a few weeks, I noticed a big hole under the armpit, so I took it back and they exchanged it now problems :)

    Definitely do not let it go, £200 is a lot of money to pay for a dress for only 4 hours use!

    this would be a good one for ~Trading Standards to get involved in.

    "not Fit for Purpose" springs to mind - this is covered under the supply of goods Act.

    ie the dress has to be fit for the purpose for which is was bought, ie being worn.

    It is obviously a fault in the design - the boning should have had some sort of "cover" over the top to prevent it coming through the fabric.

    The shop sound like their fobbing you off with excuses - they sold it, they are liable.

    If you paid by Credit Card contact your Credit Card supplier as they are equally liable!

    It has got nothing to do with the manufacturer. It's clearly a faulty product. It is up to *them* not you. To show that you must have damaged it in some way in order to cause the fault.

    Note that they must *prove* it. Them simply saying "oh you must have damaged it" is not sufficient.
