Returning a broken mirror?

Hi, just wondered if anyone could please advise. I ordered a mirror with a decorative frame from ebay and it arrived shattered so obviously i contacted the seller, who failed to reply for 2 days but was still active on ebay, with new listings and leaving feedbacks etc,

I opened a dispute and regardless of what i have said the seller just keeps saying 'i will contact courier see what they say' which has been really irritating since i have asked for a partial refund so i can purchase new glass for it, or if they could send a replacement mirror.

Anyway, i just got a message saying i've to return it for a full refund but as the courier he used to send it to me (myhermes) does not accept parcels containing glass (even though the idiot seller sent it this way anyway,and not packaged too well either!) How on earth am i supposed to return it? I don't think DHL or parcelforce will take it either.

I have even contacted eBay customer support who were about as useful as a chocolate fireguard and told me to find a suitable courier!!!:mad:
If google doesn't know it, how should i?

    Photograph the damage and upload the file to the PP dispute. Then tell the seller that the courier will not accept glass, let alone broken glass as it is a health and safety hazzard. Add the details to the dispute explaining that no courier or RM will accept broken glass.

    Then ring PP and ask them to close the dispute in your favour.

    It is dreadful that any seller would expect you to return something like this in a damaged state.

    It's an ebay claim and when i spoke to them they said they can't intervene yet, and that i should try to send the mirror back.

    I just got a message from the seller again in response to mine - I said - "Not sure how i'm supposed to send a broken mirror through the post when i can't find a courier that will take glass??"
    He said "hi couriers will accept glass but may exclude them from compensation. In this case it seems it will not matter. please return item for refund"

    I'm not happy about trying to post a box of broken glass, or the fact that i will lose out having to return it by trackable means either but really feel like i'm talking to a brick wall with this one! I only want a new mirror to fit in the frame or a partail refund so i can get one elsewhere that will fit in the frame. The mirror and frame cost me £40!!
    If google doesn't know it, how should i?

    Can't you send the frame back and throw the glass in the bin?

    He has asked me to send it all, including the glass :eek: I've said i don't want to do this, it is not safe. I've also told him i'm happy to keep the frame too and just wanted enough of a refund to have a new mirror from elsewhere sent to me but nooo he wants the lot back :mad: It's looking like i'm going to have to just going to have to put this down to experience (again!)

    ETA - I think he must doubt that it's broken but have put a link to a photosharing site where i have uploaded some showing the damage and still awaiting reply.

    Just send the frame. As long as its tracked it you will be able to claim via paypal

    Wrap the broken glass bits in newspaper and plastic bags and cellotape it up, then add it with the frame and send it back in whatever it arrived in.

    You'll have to send it tracked, but I would ask them in your reply to pay return postage, and if they don't agree, send it back anyway, and leave a negative for them.

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
  • If it's a large/heavy mirror it could cost you more to send back than it would to have a new piece of glass cut. Plain mirror cut sqaure/rectangle is pretty cheap from a glazing co. I guess this is what they're hoping you will do. And don't forget to leave them a big fat neg!

    The seller is correct though. You can send glass through the post, broken or not. If it is not suitably packaged and someone gets injured though, you could be liable.
