How long to wait?

3 weeks ago I ordered a shirt from a website. I waited a week and received nothing so I emailed them. They don't appear to be too hot on answering queries and it took 3 days to get a reply. That reply stated it was on back order and would be in stock within 2 weeks.

It is now coming up for those 2 weeks, I have had no contact at all, my item is still shown as 'pending' on their site.

I contacted again yesterday and politely requested a refund via paypal as that is how I had paid. I am unwilling to wait any longer for an item I was not told was out of stock in the first place. Again, I have heard nothing.

My question is, should I wait for them to refund themselves or, should I file a dispute now?

What would you do?
