scammed on ebay - is it worth calling - UPDATE

i bought an item via cheque - it was a rareish item and a reasonably low price (about 70 including postage), but i didnt scan the small print until after i won it re paying by cheque only (my stupid stupid fault) but i thought it would be okie as they had 1000 feedback and only one neg from when they started saying they didnt pay for an item

i sent the cheque on the 28th July, and after emailing them, they confirmed they had recieved payment and would post the item on 7th august after it had cleared.

Since then, ive had no item and no reply to my contact from them.

Ive started a not recieved item ebay dispute to which they also havent replied - and i understand that ebay will possibly refund me all but £15

I have their full contact details and yes they are registered on the electoral roll at that address. I also have their telephone number via ebay. is it worth phoning them - im a bit nervous about it in case they turn out to be a nutter or worse

otherwise i guess my other option is small claims court

any advice what to do next

****UPDATE ****

It arrived this morning - broken - it was china but only loosely wrapped in paper in a box, with no bubble wrap to prevent damage. Plus i paid an extra £10 for insurance, but they sent it ordinary standard parcels with no extra insurance

should i add all this to to my ebay dispute, as they arent replying to emails, or should i just leave the dispute as it is

    I'd call them - it's a long shot but they may be having computer problems and not seen that there's an open dispute. They also might not be aware that you haven't received your item. If in doubt, can you call from a payphone?

    They didn't send it recorded or anything even though you paid for it.
    What if it hadn't arrived. Some sellers are cheeky b@stards thinking they can get away with hoodwinking their buyers.

    He deserves an ebay spanking.
    It's BOUGHT (to Buy), not BROUGHT (to bring) AND you cannot be frauded, only DEfrauded.

    Please do not buy animals from a pet store. Visit your local sanctuary or centre and give a good home to an unloved or abandoned animal.
  • i would leave it as it is, otherwise ebay will ask you to send the item back and you may lose out on postage as it will cost you to post back to the seller, also the seller may be able to claim from the PO for item lost rather than his poor packing which resulted in the item being damaged
    it seems that paypal seem more inclined to refund you in full if you dont recieve the item than if its recieved broken:confused:
  • That is such a shame - you said that it was rare, that makes it even worse - some sellers don't have the first clue about wrapping and packing breakables and as for the rest of the stuff about the delay and lack of insurance then it all adds up to a major ebay complaint.

    List all of your grievances and hold on to the box and wrappings.

    think i will copy Soolin and only bid on items with paypal payments only

    It was a cheque so it's only ebay that will help out with this - or maybe his conscience will nag at him to refund?
  • Thanks AT - its rare in that its not made anymore, and although they do appear on ebay every so often, they arent on everyday

    plus its book price is double what I paid (hence me deciding to bid)
